The Pajama by Clara is a brand owned and operated by MCF Ecommerce LLC. We offer made-to-order pajamas, sleepwear, and loungewear featuring custom patterns, personalized text, monograms, and creative printed designs.

These Terms & Conditions govern your use of http://thepajamacrew.com and purchases made through our website. In these terms, “The Pajama by Clara,” “we,” “us,” and “our” refer to MCF Ecommerce LLC.

Without our prior written permission, you may not copy, reproduce, distribute, resell, license, or commercially exploit any website content. You may not use our brand name, trademarks, or trade dress in any manner that implies unauthorized affiliation, endorsement, or sponsorship.

4. Custom Artwork and Customer-Submitted Content

“Customer Content” refers to names, text, monograms, photographs, graphics, logos, and other assets you submit for personalization or order processing.

You retain all ownership rights in your Customer Content. By submitting content, you represent and warrant that you own or possess all necessary rights, licenses, and permissions to authorize its use on the products you order. Your content must not infringe upon or violate any third-party copyright, trademark, privacy, publicity, or other legal right.

You grant MCF Ecommerce LLC a nonexclusive, royalty-free, worldwide license to use, reproduce, resize, format, and adapt your content solely as required to generate previews, manufacture and fulfill your order, and provide customer support. We may share this content with production and fulfillment partners strictly for these purposes. This license does not allow us to use your personal photos or customized items in public marketing without your explicit consent.

We reserve the right to decline or cancel orders containing content that appears unlawful, defamatory, infringing, or unsuitable for production. If an order is canceled before fulfillment under this clause, we will issue a full refund for the affected items and paid shipping charges.

5. Product Information and Customization

Our catalog consists primarily of made-to-order printed pajamas, loungewear sets, and sleepwear items. Specific fabric blends, fits, and finishing details are detailed on each product page.

Please review product specifications, sizing charts, fabric details, colorways, and personalization entries prior to ordering. Digital mockups and design previews serve as visual representations; slight variations in color, tone, saturation, and graphic placement may occur due to device display calibrations and garment printing methods. Such standard minor variations do not constitute product defects.

You are solely responsible for verifying custom text, spelling, capitalizations, sizing selections, and design placements before submitting your order. Changes requested after production has begun cannot be guaranteed.

6. Prices, Payments, and Promotions

All prices are displayed on the website. Applicable sales taxes and shipping fees are calculated and shown during checkout. Full payment authorization is required before an order is sent to production.

Discounts, coupon codes, and promotional offers are subject to their specific terms and cannot be combined unless explicitly stated. We reserve the right to modify prices and promotional offerings at any time; updates will not retroactively affect accepted and paid orders.

7. Order Acceptance and Information Errors

Receipt of an order confirmation does not constitute our final acceptance of an order. We reserve the right to verify payment details, shipping addresses, or design authorization prior to production.

We may decline or cancel any order due to suspected fraudulent activity, stock or production limitations, unauthorized intellectual property, or pricing/typographical errors. If an error affects an order you have placed, we will contact you with the option to proceed under corrected terms or cancel for a full refund. We will never charge a higher price without your explicit confirmation.

8. Cancellations, Changes, Returns, and Replacements

All order modifications, cancellations, returns, and replacements are governed by our Return & Refund Policy:

Cancellations & Edits: Requests submitted within 12 hours of purchase can be accommodated. After 12 hours, orders enter the manufacturing queue and cannot be guaranteed for cancellation.
Made-to-Order Nature: Because items are custom-made specifically for you, we cannot accept returns or exchanges for customer-selected sizing errors, buyer's remorse, or color preference changes.
Defective, Damaged, or Incorrect Goods: If an item arrives damaged in transit, defective, or materially different from your approved order, report the issue within 30 days of delivery by emailing support@thepajamacrew.com with your order number and clear photos. We will provide a free replacement or an applicable refund.

Nothing in these terms limits statutory consumer guarantees available under applicable law.

9. Production, Shipping, and Delivery

Production timelines and delivery estimates are outlined in our Shipping Policy and at checkout. Total delivery time equals production lead time plus courier transit time.

You are responsible for providing an accurate and complete shipping address. We are not liable for non-delivery or delivery delays resulting from customer-provided address errors once an order has dispatched.

Shipments are handled by reputable third-party logistics carriers. If your package tracking reflects abnormal delays or is confirmed lost by the carrier, contact our support team promptly so we can open an inquiry and issue a replacement or refund.

10. Intellectual Property Complaints

If you believe that any material available on our website or reproduced on a custom item infringes upon your copyright or trademark rights, please submit a written notice to support@thepajamacrew.com containing:

Your name, address, email, and contact number.
Identification and description of the protected work or trademark.
Direct URL or location details of the allegedly infringing material.
A statement confirming your good-faith belief that the use is unauthorized, along with proof of ownership or authorization to act on the owner's behalf.

11. Third-Party Links and Integrations

Our website may integrate or link to third-party services (such as payment gateways and logistics providers). These external services operate under independent terms and privacy practices. MCF Ecommerce LLC does not control and is not liable for third-party platforms, though their use does not diminish our direct contractual commitments to you.

12. Limitation of Liability

To the extent permitted by law, MCF Ecommerce LLC, its directors, officers, and employees shall not be liable for indirect, punitive, incidental, special, or consequential damages resulting from site usage or purchased goods. In jurisdictions permitting liability limitations, our aggregate liability for any claim relating to an order shall not exceed the total amount paid by you for that specific order.

Certain jurisdictions do not allow the limitation of consumer guarantees, liability for gross negligence, or bodily injury; in such jurisdictions, liability is limited strictly to the minimum extent permitted by law.

13. Events Beyond Reasonable Control (Force Majeure)

We shall not be held liable for failure or delay in performance resulting from events beyond our reasonable control, including natural disasters, extreme weather, pandemic-related disruptions, labor strikes, civil unrest, acts of government, or widespread carrier and telecommunication failures. We will make reasonable efforts to notify affected customers and fulfill obligations as soon as conditions permit.

14. Suspension and Termination of Access

We reserve the right to suspend or restrict website access to any user engaging in fraud, security tampering, payment abuse, or material violations of these Terms. Suspension of site access does not waive pending fulfillment duties, lawful refunds, or existing consumer rights.
